Welcome to Asia Destination Tour (“we,” “us,” “our,” or “the Company”). These Terms and Conditions govern your use of our website [www.asiadestinationtour.com] and your booking of any tours, activities, or services offered by us. By booking a tour or using our website, you agree to be bound by these Terms and Conditions in full.

1. About Us

Asia Destination Tour is a tour operator based in Chiang Mai, Thailand, offering private guided tours and activities including but not limited to mountain treks, elephant care experiences, jungle trekking, and cooking classes.

2. Bookings and Reservations

2.1. All bookings are made through our website or by direct contact (email, phone, or WhatsApp) and are subject to availability.

2.2. Our tours are private tours, and pricing is based on group size as displayed at the time of booking. You are responsible for selecting the correct group size package matching your actual number of travelers. Misrepresentation of group size may result in additional charges on the day of the tour or refusal of service.

2.3. A booking is only confirmed once you receive a confirmation email or message from us and, where applicable, payment (or deposit) has been received.

2.4. It is your responsibility to check all booking details (dates, tour selected, number of travelers, contact information) for accuracy before confirming.

3. Pricing and Payment

3.1. All prices are listed in [USD/THB — specify your currency] and are subject to change without notice until a booking is confirmed.

3.2. We accept payment via PayPal, credit/debit card (through PayPal checkout), and cash (payable on the day of the tour, where arranged in advance).

3.3. If you require a deposit: A deposit of 50% is required to confirm your booking, with the remaining balance due 2 days before the tour date / on the day of the tour.

3.4. Prices include what is stated in each tour’s description (e.g., guide, transportation, meals as specified) and exclude anything not explicitly listed, including but not limited to travel insurance, personal expenses, gratuities, and items marked as optional.

4. Cancellations and Refunds

4.1. Cancellation by you:

  • Cancellations made more than [X days] before the tour date: [full refund / partial refund — specify]
  • Cancellations made within [X days] of the tour date: [partial refund / no refund — specify]
  • No-shows on the day of the tour are non-refundable.

4.2. Cancellation by us: We reserve the right to cancel or reschedule a tour due to insufficient bookings, safety concerns, weather conditions, or circumstances beyond our control (see Section 8, Force Majeure). In such cases, we will offer a full refund or the option to reschedule at no additional cost.

4.3. Refunds, where applicable, will be processed within [X business days] to the original payment method.

5. Changes to Itinerary

5.1. While we make every effort to deliver the itinerary as described, weather, road conditions, local regulations, animal welfare considerations, or safety concerns may require us to modify, shorten, or substitute parts of a tour.

5.2. We will always aim to provide a comparable alternative experience where changes are necessary and will inform you as soon as reasonably possible.

6. Traveler Responsibilities and Health

6.1. Some of our tours (including mountain treks and jungle trekking) involve physical activity. You are responsible for assessing your own fitness level and disclosing any medical conditions, allergies, or mobility limitations to us before booking.

6.2. We recommend all travelers obtain comprehensive travel insurance covering activity-based travel, medical emergencies, and trip cancellation before their tour date.

6.3. You agree to follow the reasonable instructions of your guide at all times for your safety and the safety of others, including instructions given during animal interactions (e.g., Elephant Care) and outdoor activities.

6.4. We reserve the right to refuse participation to anyone who appears to be under the influence of alcohol or drugs, or who we reasonably believe poses a safety risk to themselves or others.

7. Assumption of Risk

7.1. Tour activities, including but not limited to trekking, animal interactions, and outdoor excursions, carry inherent risks including but not limited to physical injury, exposure to weather and terrain, and interaction with animals.

7.2. By booking a tour, you acknowledge and voluntarily accept these inherent risks. To the fullest extent permitted by Thai law, [Company Name] shall not be liable for injury, illness, loss, or damage arising from participation in our tours, except where such injury, illness, loss, or damage is caused directly by our proven negligence.

7.3. This section does not exclude any liability that cannot be excluded under applicable Thai consumer protection law.

8. Force Majeure

We shall not be held liable for any failure or delay in performance of our obligations resulting from events beyond our reasonable control, including but not limited to natural disasters, extreme weather, government actions, pandemics, civil unrest, or transportation disruptions.

9. Minors

Travelers under the age of 18 must be accompanied by a parent or legal guardian. It is the responsibility of the accompanying adult to ensure the suitability of the tour for the minor’s age and physical ability.

10. Photography and Media

During tours, our guides or staff may take photographs or videos for use in our marketing materials, website, and social media. By participating in a tour, you consent to this use unless you inform us in writing before your tour date that you do not wish to be photographed or featured.

To the extent permitted by applicable law, our total liability to you in connection with any booking shall not exceed the total amount paid by you for that booking. We are not liable for indirect, incidental, or consequential damages, including loss of enjoyment or missed connecting travel arrangements.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from these Terms or your booking shall be subject to the exclusive jurisdiction of the courts of Thailand, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
